One small step: Fifth Circuit accepts our amicus

Earlier this month we told you that APC had submitted an amicus brief to the Fifth Circuit in the case of Zyla Life Sciences vs. Wells Pharma, supporting Wells, which wants the case to be heard en banc, i.e., by the entire Fifth Circuit.

A small bit of good news: Last Friday, May 23, the Fifth Circuit formally accepted our amicus brief. That doesn’t mean it will rule in Wells’s favor (Zyla filed a brief opposing an en banc hearing), but hopefully we’ll hear a decision in the next few weeks … and hopefully the court will hold that hearing.
