DEA allows practitioner office delivery

Written by Sean Waldron | Oct 30, 2026

In September 2024, APC wrote to DEA urging the agency to finalize guidance allowing pharmacies to deliver patient-specific controlled substances to a practitioner’s office under a patient power of attorney (POA). DEA has now delivered.

DEA’s new guidance, released Wednesday, confirms that a patient may execute a POA, consistent with state law, designating the administering practitioner as their agent to accept delivery of the patient’s prescribed controlled substance. The pathway applies to medications that must, or should, be administered in a healthcare setting. DEA specifically cites medications for intrathecal pumps.

This is a meaningful step for patients who depend on practitioner-administered therapies. It reduces diversion risk and keeps sterile medications in a controlled clinical setting rather than on a doorstep. APC thanks DEA for its engagement on this issue.

Members considering this option should review the full guidance for recordkeeping, POA verification, and handling requirements, and confirm that their POA process complies with state law. The pathway is optional; pharmacies can continue delivering directly to patients.
