FDA Agency IQ reports that a new telehealth venture has been cited by FDA for marketing a compounded GLP-1 in chocolate form, using orforglipron – the active ingredient in an FDA-approved drug protected by patent and marketing exclusivity. Simply adding chocolate doesn't circumvent federal restrictions on compounding copies of approved drugs. FDA has previously warned that a different formulation must be justified by a prescriber-documented, patient-specific need. Otherwise, it may violate federal law. Chocolate doesn't make an end run around the law any sweeter.
